2. That the material submitted is my sole and original work. That it is not now nor ever has been under option. That I own full copyright, free and clear of any interests. I understand that many stories, ideas and scripts are similar in some ways, and although many stories, ideas and scripts are different, they may share a common theme.
3. I have read and understand, comply and agree with all the rules and conditions for the Santa Barbara Script Competition. By signing this legal document I am taking full responsibility and liability for any and all of my actions. Furthermore, I indemnify and hold harmless the Santa Barbara Script Competition, SBF Partners and Alliance for Creative Commerce, its agents, employees, judges, partners, sponsors, successors and assigns from any and all claims, demands, losses, costs, damages, judgments, liabilities and expenses (including attorney's fees) arising out of or in connection with any and all claims (direct or indirect) or third parties, loss or liability, whether or not groundless, that may be asserted against you or incurred by you or any of your associates, at any time in connection with said material.
4. I understand, that if chosen for any prize category I may be asked to enter into additional agreements, including a 12 month First Look option/ purchase agreement. If I agree to enter into an option, it is understood that the cash prize I received as winner of the competition may be credited against Producer’s obligation to make option payment. I understand that as producer, during the option period, SBF Partners and or its agents and assignees shall retain all approvals and controls over the marketing of the script and development of the subsequent production of the film or television pilot. However nothing implied, stated or contained herein or in any subsequent option shall be construed to obligate producer to produce the script or teleplay.
